1. Agreement Overview

These Terms and Conditions (“Terms”) govern your use of the website https://ztong.shop (the “Site”) and your purchase of products from the Site. The Site is operated by Yiwu Zitong Trading Firm (义乌市紫童贸易商行), a sole proprietorship registered in Yiwu, Zhejiang, China (“we”, “us”, “our”). Our brand is ZTONG.

By accessing the Site, browsing our products, or placing an order, you agree to be bound by these Terms, together with our Privacy Policy and Refund and Returns Policy (both available on the Site and incorporated into these Terms by reference). If you do not agree with any part of these Terms, please do not use the Site.

3. Eligibility

You must be at least 18 years old, or the legal age of majority in your country of residence, to place an order on the Site. By placing an order you confirm that you are legally capable of entering into binding contracts and that the information you provide is accurate and complete.

4. Products and Pricing

  • Product descriptions: We work hard to describe our products (in-ear monitors, DACs, ear tips, cables and accessories) accurately, including specifications such as driver configuration, frequency response, impedance and weight. However, specifications and measurements are provided as a guide and may vary slightly between units due to manufacturing tolerances. Sound quality is subjective — the tonal characteristics we describe reflect our tuning targets and your listening experience may vary depending on your source device, ear tips and hearing.
  • Images: Product images are for illustration. Actual products may differ slightly from images shown on the Site.
  • Pricing errors: We take care to price products correctly. If a product is listed at an incorrect price, we reserve the right to refuse or cancel any order placed at the incorrect price, and to correct the price before charging you. If your card has already been charged for an order we cancel due to a pricing error, we will issue a full refund.
  • Availability: All products are subject to availability. If a product you order becomes unavailable, we will notify you and offer a substitute, a backorder, or a full refund.

5. Orders and Acceptance

  • Placing an item in your cart does not reserve it. An order is accepted by us only when we send you an order confirmation email.
  • We reserve the right to refuse or cancel any order for legitimate reasons, including suspected fraud, payment failure, stock unavailability, or where an order appears to have been placed in error or in breach of these Terms.
  • If we cancel an order after payment, we will refund the full amount paid using the original payment method.

6. Payment

  • We accept the payment methods displayed at checkout (including major credit/debit cards and, where offered, PayPal and other online payment services).
  • All prices on the Site are in US Dollars (USD) unless otherwise stated.
  • Payment is taken when you place your order (or, for pre-orders, when the pre-order is placed). Your payment details are processed by our payment providers under their own security standards; we do not store your full card details.
  • You agree that the payment details you provide are valid and that you are authorised to use them.

7. Taxes and Import Duties

  • Sales tax / VAT: Where required by law, applicable sales tax or VAT will be calculated and shown at checkout (for example, for shipments where we are required to collect tax). Where we are not required to collect tax, you may be responsible for any local taxes.
  • Import duties and customs: Orders shipped internationally may be subject to import duties, customs fees and taxes levied by your country. These charges are the responsibility of the buyer and are not included in the product price or our shipping charges, unless otherwise stated at checkout. Customs policies vary widely by country — please contact your local customs office for details. Delays caused by customs clearance are outside our control.

8. Shipping and Delivery

  • Shipping methods and times: We offer the shipping options shown at checkout. Estimated delivery times are calculated from the dispatch date and are estimates only — they are not guaranteed, particularly for international shipments subject to customs clearance.
  • Dispatch: Orders are usually dispatched within the time stated at checkout or in your order confirmation.
  • Risk of loss: The risk of loss and damage to the products passes to you when the carrier takes possession of the shipment (delivery to the carrier). However, ownership (title) of the products remains with us until we have received full payment for the order.
  • Undeliverable / refused shipments: If a shipment is refused, undeliverable, or returned to us, we will contact you. Returned shipments may be subject to a refund of the product price minus the outbound and return shipping costs we incurred.

9. Returns, Refunds and Warranty

Our returns, refunds and warranty commitments are set out in full in our Refund and Returns Policy. In summary:

  • 30-day returns for most products in original condition (hygiene exception applies to opened ear tips);
  • 48-hour damage reporting for items arriving damaged;
  • 24-month (2-year) limited warranty against manufacturing defects.

These commitments do not affect your statutory consumer rights.

10. Disclaimer and Warranty Limitations

  • “As is” content: The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law.
  • Products: Except for the express warranty in our Refund and Returns Policy and any rights that cannot be excluded under mandatory law, we give no other warranties, express or implied, regarding the products, including implied warranties of merchantability or fitness for a particular purpose.
  • Hearing safety: Listening to audio at high volume for long periods can cause permanent hearing damage. You are responsible for using our products at safe volumes. Our products are not medical devices and are not intended to diagnose, treat or prevent any condition. If you experience discomfort, discontinue use and consult a professional.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Site or purchase of products.
  • Our total liability to you for any claim arising out of or relating to these Terms, the Site, or any product purchased, whether in contract, tort (including negligence) or otherwise, shall not exceed the amount you paid for the product giving rise to the claim.
  • Nothing in these Terms limits or excludes liability that cannot be limited or excluded under the mandatory consumer-protection laws of your country of residence (including, where applicable, liability for death or personal injury caused by negligence, or for fraud).

  • The ZTONG name and logo are our trademarks (or trademarks we are applying to use). Third-party brand names mentioned on the Site (if any) belong to their respective owners and are referenced only descriptively.
  • We respect the intellectual property of others and expect the same from you. Our product designs are original; nothing on the Site is intended to infringe the rights of any third party.

13. Acceptable Use

When using the Site you agree not to:

  • Violate any applicable law or regulation;
  • Infringe the intellectual property, privacy or other rights of any third party;
  • Post or transmit malicious code, viruses or any content that is unlawful, defamatory, harassing or obscene;
  • Attempt to gain unauthorised access to the Site, its servers or connected systems;
  • Interfere with, overload or disrupt the Site or its services;
  • Use automated tools (bots, scrapers) to collect data from the Site without our permission;
  • Impersonate any person or entity or misrepresent your affiliation with us.

We may suspend or terminate access to the Site for any breach of these Terms.

  • These Terms are governed by the laws of the People’s Republic of China, excluding its conflict-of-law rules.

  • Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
  • Entire agreement: These Terms, together with our Privacy Policy and Refund and Returns Policy, constitute the entire agreement between you and us regarding your use of the Site and purchase of products, and supersede any prior agreements or understandings.
  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment: We may transfer our rights and obligations under these Terms to a third party in connection with a merger, sale or reorganisation of our business. You may not transfer your rights or obligations without our consent.
